If you have a contested case, then both the petitioner and the respondent will be required to go to court in a trial or final hearing, even though at any time during the process you can settle your case. If you have an uncontested case and you have a written agreement, then only the petitioner needs to appear at a ten minute final hearing where the agreement is incorporated into the final judgment.
