How can I keep spouse from selling property before divorce in Florida?
One you file the divorce in Florida, you can file what’s called a lis pendens. I know it sounds like a weird word, but it’s an old legal word that talks about there is an action pending. That can be filed in the property records in Florida. Once that is filed in the property records, your property cannot be sold until that lis pendens is released. You can also ask the Court for an Order restricting your spouse’s ability to sell any assets during the pendency of the action.
