Whether you have to share your pension depends on whether it is considered a marital asset or not. If your pension was acquired during the term of the marriage then it is probably going to be considered a marital asset. (You can have a Pre-Marital Agreement which would allow you to keep all of your pension.) If your spouse also has a pension that has about the same amount of funds in it, then you would each keep your own pension. If your pension was the only pension that was acquired during the marriage and if you do not have an agreement otherwise, you would normally divide the marital portion of the pension equally between the two of you.
