How is collaborative divorce different from litigation in Florida?

A collaborative divorce is a divorce where you have an agreement with your spouse and between the attorneys that neither party will file litigation. It is actually a completely separate process. In a collaborative divorce, you are trying to settle everything before you ever file anything in the court system. Eventually, you will have to file the petition and everything within the court system but it will all be uncontested if you have come to an agreement through the collaborative process.  The negative side of it is that the attorneys who represent you for the collaborative divorce cannot represent you if the divorce becomes contested.  Even if it does become contested, it can always be resolved without litigation.
