Essentially, your ex would not be entitled to any pension procured after the divorce is final. Before the divorce is final, the first step in dividing a pension is analyzing what type of pension is actually being offered. Generally what happens is that the court could award as much as 50 percent of the marital portion of the pension, but again there are some exceptions to this, such as if you’re receiving a VA compensation, that may not be included as an equitable distribution award. Also, how much your spouse will receive of your pension depends upon how much of the pension is pre-marital and how much of it is marital. Division of pensions can be complicated.
