Can I get a divorce in Florida even if my spouse is incarcerated?
You can file for divorce as long as Florida has jurisdiction over the case, which means that you or your spouse have to have been a resident of Florida for the past six consecutive months, even if the respondent is incarcerated. As usual, you would need to serve the respondent with the Petition for Dissolution of Marriage where he or she is incarcerated. It would be either served with by process server or otherwise by agreement of the parties. See the divorce process.
