See the following on our specific areas in divorce and family law we practice:
Uncontested Divorce
It is always best if the parties to a case can work with each other through their attorneys to come to an agreement as to the terms of settlement in their case and have in essence an uncontested divorce. If the case is fairly simple and agreed upon, it is still helpful to have one of our top Brandon divorce lawyers by your side to represent you in preparing and filing all of the documents (pleadings) necessary before a divorce can be granted. Even simple divorces may require a marital settlement agreement and if there are children involved, then there are additional pleadings which must be filed for child custody and visitation and child support.
In addition, when the parties agree and have a signed settlement agreement, and if they have children a signed parenting plan, then these will be incorporated into a Final Judgment and a final hearing before the judge is necessary. It is usually the person who files the petition who must attend the final hearing. Nonetheless, this hearing is uncontested and you are only asked a few questions to verify your identity and that the court has jurisdiction, and that the parties are in agreement with the signed documents. An uncontested final hearing will usually only last five to ten minutes.
Contested Divorce
When a divorce initially seems like it will be a contested divorce, the assistance of attorneys to represent each party is particularly important as it is very likely they cannot talk with each other. The goal though, even if initially it is contested, is to attempt to come to an agreement, if at all possible, and this can be accomplished at anytime throughout the divorce process. Settlement can be by the attorneys preparing a marital settlement agreement and parenting plan, if children, and signed by the parties. Or by private mediation which is especially helpful if there are complicated issues of alimony, child custody and support, division of assets and debt, retirement account division, etc. However, if the parties are unable to resolve their differences, our attorneys and legal staff have years of experience litigating divorce and other family law matters. We will be zealous in our representation to obtain the best results possible considering the circumstances.
Family Law Issues
Our Brandon family law attorneys can assist when there are issues which must be resolved concerning children when the parents are not married. Either the mother or father can seek a determination of paternity and they do so for very different reasons. In fact, a father must seek a determination of paternity as he does not otherwise have any legal rights to the child, even if his name is on the birth certificate. Only after being declared by the court that he is the legal father will he be able to ensure that he has the right to custody and visitation with the child, as well as the other obligations which come with being a father.
Other family issues where having an experienced family lawyer by your side is valuable include modifying, enforcing or domesticating a final judgment of divorce or paternity. Basically, any action which arises out of a finalized divorce or paternity action. Furthermore, our family attorneys in Brandon are well versed in the name change of minors and adults, as well as stepparent and relative adoption.
In addition, we also practice in criminal defense as that is also a family matter.
