Can I file for divorce in Florida if spouse is in military & stationed in  another country?

You can file for divorce if your husband or wife is in the military and on active duty. However, there is a federal law called the Service Member’s Relief Act that states that a person cannot be forced into litigation while they are on active duty overseas. In that situation and always you can negotiate an agreement with your spouse, so that there is no litigation.  The reason for this is that our country wants to protect our service members as they would not be able to immediately come back for court dates.
