My spouse is trying to kick me out of our home. Is that legal?
Assets that are acquired during the marriage including the marital home are assets owned by both parties; and, therefore one party cannot force the other party to vacate the residence unless there is a court order requiring that. There can only be a court order if there is a divorce or domestic violence case pending. Furthermore, even if you are living in a non-marital residence, you cannot generally be removed from the house except through court order or domestic violence injunction until the divorce can be finalized.
