After you serve the respondent, he or she would have twenty days after the date of service to respond to (answer) the petition for divorce and possibly file a counter petition including their requests from the court. If they fail to file with the Court, their response within that twenty day time period then you could move for a default against them. After the default is obtained either by the clerk’s office or judicial default, then you can proceed with requesting a final hearing. However, keep in mind that if children are involved, then testimony regarding their best interest is required.
