If you are thinking about ending your marriage, you have likely wondered how much it will cost you. Divorce can be an expensive process, but that also does not always have to be the case. Generally speaking, the more disputes that arise in a case, the more expensive the divorce is. Uncontested divorces involve two spouses who agree to all the different terms of the case. These are the most affordable divorce cases. Still, it is unlikely that you will leave the divorce process without paying anything at all. How Much Does an Uncontested Divorce Cost?

 In addition to agreeing to all of the different terms of the divorce, you must meet other requirements under state law. Namely, this means that either you or your spouse has lived in Florida for at least six months before filing for divorce. As with other divorce cases, the cost of your case will vary depending on several factors. The approximate costs of uncontested divorce cases are as follows:

  • If you complete the paperwork yourself and do not have any legal representation, the cost is approximately $500.  That would be for the filing fee and possibly service of the Petition on your spouse.
  • If you have legal guidance without an attorney except at the final hearing, the cost can be a flat fee of $850 to $1,250 with children, plus approximately $500 for the cost deposit including the filing fee.  A flat fee is possible only when there are no contested issues.  Usually there are no assets, debts or children.
  • If you have legal representation with an attorney and you are able to resolve your case by agreement or mediation relatively quickly, you will spend approximately $3,000 to $5,000 plus cost deposit of approximately $500.

While an uncontested divorce case does become more expensive when working with a lawyer, everyone should have legal representation when getting a divorce. A lawyer will inform you of your rights and make sure they are upheld throughout the process. The courts will also not provide you with legal advice and one mistake can create unnecessary delays, which will add to the cost. A lawyer will not make these errors and will provide the legal help you need.

How Long Does an Uncontested Divorce Take in Florida? 

As with every divorce, the length of time an uncontested divorce will take depends on the facts of the case. All divorce cases in Florida, with very few exceptions, are subject to the 20-day waiting period. This means your case cannot be finalized before 20 days have passed since filing the papers with the appropriate court. Still, it is very unlikely that your case will be finalized within this time. In the majority of cases, an uncontested divorce will take anywhere between six weeks and six months.
