Tampa Modification Attorney
Modify, Enforce & Domesticate Judgments
Final judgments and marital and paternity settlement agreements legally set forth a court’s order or the parties’ agreement regarding issues such as child custody, child support, visitation rights and alimony. If one party wishes to modify a child custody, child support, spousal maintenance or time sharing plan or agreement, the modification must be approved by the court. If the parties’ agree, generally the court will approve the parenting plan; however, child support is strictly construed pursuant to the Florida child support guidelines worksheet, regardless of the parties’ agreement.
We at All Family Law Group have successfully handled modifications for hundreds of families in the Hillsborough County and the Tampa Bay area. Post judgment modifications most often occur after one party relocates, changes jobs, experiences a change in income or is dissatisfied with an existing and unworkable parenting time or visitation arrangement. Modifications can also be pursued if one party is not meeting the terms of the agreement.
Our family law attorney team in Tampa will represent you in court-required mediation and in modification final hearings, if one is necessary. We will investigate your situation and provide informed, personalized and passionate advocacy. For instance, in a custody modification case, we will advocate for you based on:
- Who has been taking care of your child
- Who takes your child to school and extracurricular activities, and who knows your child’s teachers and friends
- Who attends school meetings
- Who does and who does not provide a stable environment
- Whether domestic violence has occurred
Enforcement and the Domestication of Foreign Judgments.
“Foreign judgments” are family court judgments made in other states. A party’s ability to modify and enforce judgments made in other states is often contingent on having the judgment “domesticated” so that it can be handled in Florida. We may be able to domesticate judgments if you have moved here from another state and can work to enforce or possibly modify, judgments made both in Florida and in another state.
